​1. INTRODUCTION
These Terms and Conditions ("Terms") govern your use of services provided by The Furious Inc ("we," "our," "us"), a trucking company located at 38 TRIANGLE PARK DR SUITE 3806, CINCINNATI, OH 45246. By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.
2. SERVICES
2.1 Service Description
The Furious Inc provides transportation services using 53' dry van loads. Our services include the pickup, transportation, and delivery of goods throughout the United States.
2.2 Service Availability
We operate in all 50 states of the United States. We reserve the right to decline service to certain locations at our discretion based on factors such as road conditions, weather, or regulatory restrictions.
2.3 Scheduling and Timing

We strive to meet all pickup and delivery schedules as agreed upon in our service agreements.

Transit times provided are estimates only and are not guaranteed unless specifically stated in writing.

We are not responsible for delays caused by factors beyond our control, including but not limited to: traffic conditions, road closures, weather events, or compliance with regulatory requirements.
3. RATES AND PAYMENT
3.1 Rate Determination

Our transportation rates are determined based on factors including distance, weight, dimensions, special handling requirements, and current market conditions.

Rate quotes are valid for the period specified in the quote and are subject to change without notice unless confirmed by a written agreement.
3.2 Additional Charges
Additional charges may apply for services including but not limited to:

Detention time beyond the allotted loading or unloading time

Storage of goods
-
Additional stops
-
Special handling requirements

Fuel surcharges
-
Toll roads and permits
-
Weekend or holiday service
3.3 Payment Terms

Payment is due within 30 days from the date of invoice unless otherwise specified in a written agreement.

We accept payment by check, ACH transfer, and credit card.

Late payments may be subject to interest charges at the rate of 1.5% per month or the maximum rate permitted by law.
4. SHIPPING AND DELIVERY
4.1 Cargo Documentation

The shipper is responsible for providing accurate and complete documentation, including but not limited to bills of lading, shipping manifests, and any required customs documents.

Inaccurate or incomplete documentation may result in delays, additional charges, or refusal of service.
4.2 Packaging and Loading
-
The shipper is responsible for properly packaging goods to withstand normal transportation conditions.

The shipper is responsible for properly securing cargo for transport, unless loading services are specifically arranged with us.

We reserve the right to refuse shipment of improperly packaged or secured goods.
4.3 Inspection of Goods

We reserve the right to inspect any shipment for safety, security, or regulatory compliance.

The receiver should inspect goods upon delivery and note any damage or discrepancies on the delivery receipt before accepting the shipment.
5. LIABILITY AND INSURANCE
5.1 Cargo Liability

Our liability for loss or damage to cargo is limited to $0.50 per pound per article, with a maximum liability of $100,000 per shipment, unless a higher value is declared in writing and agreed to by us prior to shipment.

Claims for loss or damage must be filed in writing within 9 months of the date of delivery, or in the case of non-delivery, within 9 months of the expected delivery date.

Our liability begins when we take possession of the goods and ends upon delivery or attempted delivery.
5.2 Limitations of Liability
We shall not be liable for:

Loss, damage, or delay caused by acts of God, public authorities, strikes, labor disputes, civil unrest, hazards of air or road transportation, acts or omissions of customs officials, or other circumstances beyond our control.

Consequential, indirect, or punitive damages, including but not limited to loss of profit or income, regardless of whether we had knowledge that such damages might occur.

Damage caused by improper packaging or loading, unless such services were provided by us.

Concealed damage or damage not noted at the time of delivery
5.3 Insurance

We maintain insurance coverage as required by applicable federal and state regulations.

Additional cargo insurance may be available at an additional cost upon request and prior arrangement.
6. COMPLIANCE WITH REGULATIONS
6.1 Regulatory Compliance

We comply with all applicable federal, state, and local regulations, including but not limited to those issued by the Department of Transportation (DOT) and the Federal Motor Carrier Safety Administration (FMCSA).

We reserve the right to delay or reschedule shipments as necessary to comply with these regulations.
6.3 Hazardous Materials

We do not transport hazardous materials unless specifically agreed to in writing.

Transport of hazardous materials requires proper classification, packaging, labeling, and documentation in accordance with federal regulations.
7. TERMINATION OF SERVICES
7.1 Termination by Either Party

Either party may terminate the service relationship at any time by providing written notice to the other party.

Ongoing shipments at the time of termination will be completed according to the original agreement unless otherwise specified.
7.2 Termination for Cause
We reserve the right to immediately terminate services for:

Non-payment or late payment of invoices

Providing false or misleading information

Violation of these Terms

Illegal activities
-
Any action that poses a safety or security risk
8. DISPUTE RESOLUTION
8.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to conflicts of law principles.
8.2 Arbitration
Any dispute arising out of or relating to these Terms or our services shall be resolved by binding arbitration in Cincinnati, Ohio, in accordance with the rules of the American Arbitration Association.
​8.3 Limitation on Time to File Claims

Any cause of action or claim you may have with respect to our services must be commenced within one (1) year after the cause of action accrues.
9. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless The Furious Inc, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that arise from or relate to:

10. FORCE MAJEURE
We shall not be liable for any failure to perform our obligations under these Terms where such failure is as a result of acts of nature (including fire, flood, earthquake, storm, hurricane, or other natural disaster), war, invasion, civil unrest, government order or law, strikes or labor disputes, or other events beyond our reasonable control.
11. CHANGES TO TERMS
We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on our website. Your continued use of our services following the posting of revised Terms means that you accept and agree to the changes.
12. ELD AND GPS TRACKING
12.1 Electronic Logging Devices (ELDs)
We use TT ELD for compliance with Federal Motor Carrier Safety Administration (FMCSA) regulations. This system collects data including hours of service records, duty status logs, engine data, and vehicle movement data for regulatory compliance and fleet management.
12.2 GPS Tracking
We use Samsara for GPS tracking of our vehicles. This system collects data including real-time vehicle location, route information, speed and driving patterns, and stop times and locations for fleet management and customer service purposes.
13. SEVERABILITY
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.
14. ENTIRE AGREEMENT
​These Terms constitute the entire agreement between you and The Furious Inc regarding the use of our services, superseding any prior agreements between you and us.
